- Inform us of any safety hazards, fragile items, or special considerations

- Obtain necessary permissions if the property is not solely owned by you
Warranties and Disclaimers
1. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability and fitness for a particular purpose
- Warranties that services will be uninterrupted, timely, secure, or error-free

2. Service Limitations

3. Pre-Existing Conditions
We are not responsible for damage to windows or property that existed prior to our service or that results from manufacturing defects, improper installation, age-related deterioration, or extreme weather conditions. We will make reasonable efforts to identify and inform you of pre-existing conditions before service.
Limitation of Liability
1. Consequential Damages Exclusion
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CLEARVIEW, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
2. Maximum Liability Cap
Our total liability for any claims arising from or related to our services, whether in contract, tort, or otherwise, shall not exceed the amount you paid us for the specific service giving rise to the claim, or one hundred dollars ($100), whichever is greater.
3. Time Limitation for Claims
Any claim arising from our services must be brought within thirty (30) days after the service was completed. Claims brought after this period will be barred.
4. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
Indemnification Obligations
You agree to indemnify, defend, and hold harmless Clearview Window, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of our services or website
- Your violation of these Terms and Conditions
- Your violation of any rights of another party, including intellectual property rights
- Your violation of any applicable law or regulation
- Any false or misleading information you provide to us
- Your negligent or willful misconduct
- Any damage to property or injury to persons caused by your actions or omissions
This indemnification obligation will survive the termination of these Terms and Conditions and your use of our services.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Clearview Window operates, without giving effect to any principles of conflicts of law.
2. Jurisdiction and Venue
You agree that any legal action or proceeding arising out of or relating to these Terms or your use of our services shall be instituted exclusively in the state or federal courts located in our operating jurisdiction. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue.
3. Dispute Resolution Process
Before filing any legal action, you agree to first attempt to resolve any dispute through good faith negotiation with us. If a dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue legal remedies.
4. Class Action Waiver
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms.
The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any other legal notices or agreements published by us on our website, constitute the entire agreement between you and Clearview Window concerning your use of our services.
These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and us with respect to our services.
